Please read these Terms and Conditions (“Terms”) carefully before using this website, which is operated by Wild Goose LLC, Wild Goose Tours, Arctic Expedition Service (“us”, “we”, or “our”).

Your access to and use of this website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use this website.

By accessing or using this website you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access or use this website.

 

Reservations

Reservations can be made by visiting www.wildgoose-tours.com, calling +1-206-429-4767, or contacting us via email at info@wildgoose-tours.com. Pursuant to TSA Secure Flight Program requirements, travelers are required to make reservations in the name that is listed on the government-issued document he or she will use for travel. Travelers must ensure their names are correctly listed on invoices and travel package documents. If you need to make any changes to a name after travel documents have been issued, you will be responsible for any applicable name change fees.

 

Prices

Prices are correct at the time of publication; however, as airfares, aircraft availability, hotel rates and room availability, tour prices and availability, ticket prices for events, vehicle type, and transfer availability continually fluctuate and add applicable surcharges, package prices and availability will change accordingly. In the event of computer or human error, we reserve the right to re-invoice customer for the correct price or service.

 

Payments and Cancellation Policy

A deposit is due at the time a reservation is made. All deposits are non-refundable and non-transferrable. All reservations, except where specified, will require a deposit and will clearly specify the amount due as well as monthly payment plans, if applicable. We reserve the right to cancel your booking if full payment is not received in a timely fashion.

Once reservations have been made, cancellations will only be accepted in writing via email to info@wildgoose-tours.com. This email should include your full name, date of travel, and invoice/account/package number.

Changes to an existing reservation, regardless of the reason for the change, will incur a charge per person, plus any additional supplier/vendor fees which will be determined at request of changes. This policy includes name changes, and/or removal/addition of any services.

By submitting a deposit or payment, you formally accept our Terms and Conditions as stated herein.  Any violation on your part will constitute a breach and forfeiture of any and all payments.

 

Refund Policy

All payments to us are non-refundable and non-transferable. This policy is because we have contractual agreements with hotels, airlines, and other vendors that will not allow us to obtain any refunds. This policy enables us to keep our package prices competitive and allows you to make monthly payments on your vacation.

 

Travel Documentation

Traveler is responsible for ensuring that he or she meets foreign entry requirements and that his or her travel documents, such as passports and visas, are valid and compliant. We urge customers to review travel prohibitions, warnings, announcements, and advisories issued by the relevant governments prior to booking travel to international destinations.

 

Trip Details and Documentation

Provided full payment is received no later than your Final Payment Due date, travel details and documentation will be sent via email and/or mail no later than 21 days prior to travel. If paper documents are requested when e-documents are available, documents will be delivered to you via USPS approximately 14-21 days prior, and a $40 convenience fee will apply. A physical address (no PO Box) is required.

Age Requirements

 Unless otherwise stated, no one under the age of 21 is allowed to attend our vacations.  If children are allowed, all children under 18 must be accompanied by an adult.

 

Airline Policy

We are not responsible for the services and policies imposed by the applicable airlines. Airline schedules and flights are subject to change without notice. We are not responsible for penalties incurred for tickets, international or domestic, not issued by us due to schedule and/or flight changes. Airline reservations completed online are subject to review and should we deem it necessary, may be rebooked to match minimum connecting time requirements and/or travel package itineraries, in which case customer will be notified immediately.

Airlines reserve the right to demand immediate issuance of tickets whenever they determine that specific flights are heavily booked, even when normal ticketing rules do not require tickets to be issued until a later date. In this instance, we will require immediate and full payment of the airfare. This situation overrides invoice terms and conditions, and payment due dates through any payment plans you may enter into with us. If full payment is not received, seats will be cancelled by the airline and may not be available to be rebooked on the same flights or at the same airfare. Any replacement air arrangements and airfare will be the sole responsibility of the traveler. We will do our best to use major carriers for these flights. There may be times when discount carriers are used.  Travelers will be notified beforehand if this is the case.

 

Hotels and Cruises

Our hotel and cruise ship profiles are based upon information provided to us by hotel and cruise ship partners and their representatives, including images and descriptions of individual properties. We do our best to maintain current information, however we are not responsible for any inaccuracies, changes in description details or amenities, or images provided by third parties.

Cruise itineraries and ships are subject to change without notice. Furthermore, cruise ships may be chartered and/or departure dates canceled, in which case all monies will be refunded in accordance with applicable cruise line policy. We take no responsibility for ship substitutions or itinerary changes imposed by a cruise line, and we are not responsible for any losses you may incur, including the issuance and/or cancellation of airline tickets or visa fees.

Vendor Rules and Restrictions

Additional terms and conditions from our suppliers and vendors will apply to your reservation and purchase of travel-related goods and services that you select. Please read these additional terms and conditions carefully. If you have purchased an airfare, please ensure you read the full terms and conditions of carriage issued by the supplier, which can be found on the supplier/vendor’s website. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due, and compliance with the supplier/vendor's rules and restrictions regarding availability and use of fares, products, or services. Airfare is only guaranteed once the purchase has been completed and the tickets have been issued. Airlines and other travel suppliers may change their prices without notice.

You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier/vendor's rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur because of such violation.

Intellectual Property Considerations

This website and its original content, features and functionality is owned by Wild Goose LLC., DBA Wild Goose Tours, Arctic Expedition Service and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

 

Links to Third-Party Websites

This website may contain links to third-party web sites or services. We do not own, have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. By accessing and using this website, you further acknowledge and agree that Wild Goose LLC., DBA Wild Goose Tours, Arctic Expedition Service shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or relating to use of or reliance on any such content, goods, or services available on or through any such websites or services.

 

Indemnification

You agree to defend and indemnify Wild Goose LLC., DBA Wild Goose Tours, Arctic Expedition Service and/or its respective suppliers/vendors, and any of their officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

1.    your breach of these Terms,

2.    your violation of any law or the rights of a third party, or

3.    your use of our Services

 

Assumption of Risk

By using Wild Goose LLC., DBA Wild Goose Tours, Arctic Expedition Service services, you are aware that travel such as that you are undertaking involves hazardous activities, with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of Wild Goose LLC., DBA Wild Goose Tours, Arctic Expedition Service, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. You are aware that weather conditions may be severe, adverse and/or unpleasant. You are also aware that medical services or facilities may not be readily available or accessible during some or all the time during which you are participating on the trip. To partake of the enjoyment and excitement of this trip you are willing to accept the risks and uncertainty involved as being an integral part of your adventure. You hereby accept and assume full responsibility for all risks of illness, injury, or death and of the negligence of Wild Goose LLC., DBA Wild Goose Tours, Arctic Expedition Service and agree to hold harmless and release Wild Goose LLC., DBA Wild Goose Tours, Arctic Expedition Service from claims of third-party negligence. You understand the physical requirements of the activity in which you will be participating, and you currently have no known physical, medical or mental condition, which would impair your ability to participate in travel or your safety in this activity, and you are willing to assume all risks that may be created, directly or indirectly, by any such condition.

 

Media Release

We may take photographs or video (“media”) of our trips, and travelers grant us permission to do so, and for us to use this media for promotional or commercial use without payment of any compensation to traveler.

 

Termination

We may terminate or suspend access to our website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

All provisions of these Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any legal action that could arise out of the use of or access to this website must be brought in a court of law located in King County within the State of Washington.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding this website, and they supersede and replace any prior agreements we might have regarding the website.

 

Notice of Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.  We will provide notification of changes on this page if material changes to this policy are made. What constitutes a material change will be determined at our sole discretion.
